Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Precision Patch Pros website, online forms, communications, estimates, scheduling services, and related services provided by Precision Patch Pros (“Precision Patch Pros,” “we,” “us,” or “our”).

By accessing our website, submitting a request, requesting an estimate, scheduling service, communicating with us, or otherwise using our services, you agree to these Terms. If you do not agree with these Terms, please do not use our website or services.

1. Our Services

Precision Patch Pros provides residential and commercial drywall and plaster repair services, which may include:

  • Drywall patching and repair

  • Plaster repair

  • Wall and ceiling repair

  • Texture matching

  • Popcorn ceiling removal and refinishing

  • Paint touch-ups following repairs

  • Repair work following plumbing, electrical, water, pet, or accidental damage

  • Related wall and ceiling repair services

The specific services provided for a customer will be described in the applicable estimate, proposal, invoice, work order, or written agreement.

Information on our website is provided for general informational purposes. Website content does not constitute a binding estimate, guarantee, or contract for services.

2. Estimates and Quotes

We may provide estimates based on photographs, videos, measurements, descriptions, or other information supplied by the customer.

Estimates provided remotely are based on the information available to us at that time. Pricing or the scope of work may change if conditions at the property differ from the information supplied, concealed damage is discovered, additional work is requested, or access to the work area is restricted.

We will communicate material changes to the scope or price before performing additional work whenever reasonably possible.

An estimate does not reserve an appointment unless we confirm the scheduled service date and time.

3. Scheduling and Property Access

Customers are responsible for providing accurate contact information, property information, and access instructions.

The customer must ensure that an adult authorized to approve the work is present or available during the scheduled service unless other arrangements have been approved in advance.

Customers must provide reasonable access to the work area and disclose known hazards, including:

  • Mold or suspected mold

  • Asbestos or suspected asbestos

  • Lead-based paint

  • Active water leaks

  • Electrical hazards

  • Structural damage

  • Pest infestations

  • Unsafe working conditions

Precision Patch Pros may pause, reschedule, or decline work when conditions are unsafe, when the requested work falls outside our licensed scope, or when specialized testing or remediation is required.

Scheduled arrival times may be affected by traffic, weather, jobsite conditions, material availability, or delays at earlier appointments. We will make reasonable efforts to notify customers of material scheduling changes.

4. Customer Responsibilities

The customer agrees to:

  • Provide complete and accurate information about the requested work.

  • Remove fragile, valuable, or personal items from the work area.

  • Provide access to electricity and water when reasonably required.

  • Keep children, pets, tenants, and other occupants away from active work areas.

  • Obtain any required permission from a landlord, property owner, homeowners association, or other authorized party.

  • Notify us of any known hazardous materials or unsafe conditions.

  • Inspect the completed work and raise any concerns within a reasonable period.

Unless included in the written scope of work, Precision Patch Pros is not responsible for moving large furniture, disconnecting appliances, removing hazardous materials, performing mold remediation, repairing active leaks, or correcting structural defects.

5. Payments

Payment terms will be stated in the applicable estimate, proposal, invoice, or service agreement.

Unless otherwise agreed in writing, payment is due when the work is completed. Deposits may be required for certain projects, materials, or scheduled work.

Customers agree to pay all approved charges, including approved changes to the scope of work. Returned payments, chargebacks, or overdue balances may be subject to reasonable collection costs and any fees permitted by law.

Submitting a payment dispute or chargeback does not remove the customer’s responsibility to pay for properly authorized and completed services.

6. Cancellations and Rescheduling

Customers should notify us as soon as possible when an appointment must be canceled or rescheduled.

Precision Patch Pros may establish cancellation, rescheduling, or deposit policies for individual projects. Any applicable fee or nonrefundable deposit will be disclosed before the customer accepts the estimate or schedules the work.

We may cancel or reschedule a service appointment due to unsafe conditions, severe weather, illness, vehicle or equipment issues, material delays, access problems, or circumstances outside our reasonable control.

7. Workmanship Warranty

Any workmanship warranty offered by Precision Patch Pros will be subject to the terms stated in the estimate, invoice, warranty document, or service agreement.

Unless expressly included in writing, warranties do not cover damage caused by:

  • New or recurring water intrusion

  • Plumbing or roof leaks

  • Structural movement or settling

  • Foundation movement

  • Impact or accidental damage

  • Pest activity

  • Mold, moisture, or environmental conditions

  • Work performed or modified by another contractor or property occupant

  • Failure of existing paint, drywall, plaster, framing, texture, or building materials

  • Conditions outside the repaired area

  • Normal wear and tear

Color and texture matching may be affected by the age, fading, condition, application method, or availability of the original materials. We will make reasonable efforts to provide a close and professional match, but an exact match cannot be guaranteed in every situation.

8. Photographs and Project Documentation

Customers may submit photographs or videos to help us evaluate a project and prepare an estimate.

We may photograph the work area before, during, and after service for documentation, quality control, training, warranty administration, and dispute resolution.

We will not intentionally publish photographs that clearly identify a customer, street address, personal documents, family members, or other sensitive information without permission.

Before-and-after project photographs may be used for our portfolio, website, social media, advertising, or educational materials when they do not disclose private customer information. Customers may ask us in writing not to use images from their project for marketing purposes.

9. Website Use

You may use our website only for lawful purposes.

You may not:

  • Attempt to interfere with the website’s security or operation.

  • Submit false, deceptive, abusive, or fraudulent information.

  • Use automated tools to copy, scrape, or overload the website.

  • Impersonate another person or submit requests without authorization.

  • Upload malicious code, unlawful content, or content that infringes another person’s rights.

  • Use our website or communications systems to harass our staff or other people.

We may restrict access to the website or decline requests that appear fraudulent, abusive, unlawful, or harmful.

10. Intellectual Property

The website and its content, including text, graphics, photographs, videos, branding, logos, designs, and service descriptions, are owned by or licensed to Precision Patch Pros and are protected by applicable intellectual property laws.

You may view and use the website for personal, noncommercial purposes. You may not reproduce, sell, modify, distribute, or commercially use our website content without prior written permission.

11. Electronic Communications

By submitting an online form, emailing us, calling us, or otherwise contacting us, you agree that we may respond electronically or by telephone using the contact information you provide.

Electronic records, confirmations, estimates, invoices, and notices may satisfy legal requirements that communications be provided in writing, to the extent permitted by law.

12. SMS and MMS Messaging Terms

Precision Patch Pros SMS Program

When you specifically opt in to receive text messages from Precision Patch Pros, you consent to receive SMS or MMS messages at the mobile number you provided.

Messages may include:

  • Responses to quote or information requests

  • Requests for project photographs or additional details

  • Appointment confirmations and reminders

  • Scheduling and arrival updates

  • Estimate and invoice notifications

  • Service and project updates

  • Customer support messages

  • Follow-up and review requests

  • Occasional promotions or special offers when you have consented to marketing messages

Message frequency varies depending on your requests, scheduled services, and interactions with Precision Patch Pros.

Message and data rates may apply. Your wireless carrier’s rates and terms govern charges associated with receiving or sending text messages.

Consent to receive marketing text messages is not a condition of purchasing any goods or services. You may request service by calling us directly without consenting to marketing messages.

Your consent to receive SMS is not shared with 3rd parties.

 

Opting Out

You may cancel SMS messages at any time by replying STOP to any message from Precision Patch Pros.

After you send STOP, you may receive one final confirmation message stating that you have been unsubscribed. After that confirmation, we will no longer send messages covered by that SMS program unless you opt in again.

We may also recognize similar opt-out requests, such as CANCEL, END, QUIT, or UNSUBSCRIBE, where supported by our messaging provider.

An SMS opt-out applies to text messages and does not necessarily cancel a scheduled appointment, active service request, contractual notice, email communication, or phone call.

Mobile Information and Consent Data

We do not sell mobile phone numbers, SMS opt-in information, or SMS consent records.

Mobile information and text-message consent data will not be shared with third parties or affiliates for their own marketing or promotional purposes. We may provide limited information to service providers that help us deliver communications, operate our systems, schedule services, process requests, or support our business. These providers may use the information only to perform services on our behalf.

Text messaging originator opt-in data and consent will not be shared with third parties for unrelated marketing purposes.

Carrier Disclaimer

Wireless carriers are not responsible for delayed, blocked, or undelivered messages.

Message delivery is subject to your carrier’s network availability, device compatibility, service plan, and other conditions outside the control of Precision Patch Pros.

Supported Carriers and Devices

SMS and MMS availability may vary by carrier, device, and location. Not all mobile devices or wireless carriers support every message type or feature.

Privacy

Your participation in our messaging program is also governed by our Privacy Policy. The Privacy Policy explains how we collect, use, store, and protect personal information.

13. Third-Party Services

Our website or communications may contain links to third-party websites, payment processors, financing providers, review platforms, maps, scheduling systems, or social media platforms.

Precision Patch Pros does not control and is not responsible for the availability, content, security, privacy practices, or terms of third-party services. Your use of a third-party service is governed by that provider’s terms and policies.

14. Disclaimer of Warranties

Except for warranties expressly provided in writing, the website and its content are provided on an “as available” basis.

To the fullest extent permitted by law, Precision Patch Pros disclaims implied warranties concerning the website, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

15. Limitation of Liability

To the fullest extent permitted by law, Precision Patch Pros will not be liable for indirect, incidental, special, punitive, or consequential damages arising from the use of our website, electronic communications, or services.

Our liability relating to a specific service project will not exceed the amount paid to Precision Patch Pros for the portion of the work giving rise to the claim, except where a different limitation is required by law or stated in a signed agreement.

These limitations do not apply where liability cannot legally be limited, including liability resulting from fraud, willful misconduct, or other conduct that cannot be excluded under applicable law.

16. Indemnification

To the extent permitted by law, you agree to indemnify and hold Precision Patch Pros harmless from claims, damages, losses, or expenses resulting from:

  • Information you knowingly provide that is false or misleading

  • Your unauthorized use of another person’s property or contact information

  • Your violation of these Terms

  • Unsafe or undisclosed conditions at the property

  • Your violation of another person’s rights

This section does not require a customer to indemnify Precision Patch Pros for our own negligence, willful misconduct, or violation of law.

17. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules.

Any legal proceeding relating to these Terms or our services must be brought in a court with jurisdiction over the area where Precision Patch Pros principally operates, unless applicable consumer law provides otherwise.

18. Changes to These Terms

We may update these Terms periodically to reflect changes to our services, communication practices, technology, or legal obligations.

The revised Terms will be posted on this page with an updated effective date. Your continued use of the website or services after revised Terms are posted constitutes acceptance of the revised Terms, except where additional consent is required by law.

19. Severability

If any part of these Terms is held to be invalid or unenforceable, the remaining sections will remain in effect. The invalid provision will be interpreted or modified only to the extent necessary to make it enforceable.

20. Entire Agreement

These Terms, our Privacy Policy, and any applicable estimate, proposal, invoice, warranty, work order, or signed service agreement form the agreement between the customer and Precision Patch Pros concerning the applicable website use or services.

When a signed project agreement conflicts with these Terms, the signed project agreement will control for that project.
